Golden Visa: What Applies

Clarifications regarding the acquisition of real estate in Greece for obtaining the Permanent Investor Residence Permit (Law 5083/2023 as amended and enforced by Law 5100/2024)
1. WHAT APPLIES FOR Golden Visa FROM 01/09/2024
  - For Attica, the Regional Unit of Thessaloniki in the Region of Central Macedonia, the Regional Units of Mykonos and Thira in the Region of the South Aegean, and for islands with a population, according to the latest census, exceeding three thousand one hundred (3,100) inhabitants: The minimum purchase value for real estate is set at 800,000 €.
2. Other Areas: The minimum purchase value for real estate is set at 400,000 €
  - The minimum investment value applies to only one (1) property.
  - Other spaces (warehouse/warehouses and/or parking space/spaces), which cumulatively:
    1. are purchased by the investor under the same sales contract,
    2. are located in the same building, and
    3. constitute auxiliary use areas, either as annexes to the property or as separate horizontal properties, which, according to current legislation, are included in the determination of the minimum value.
  - A minimum area of main spaces of 120 m². This restriction does not apply to plots, grounds for which a building permit has not been issued, or to non-structured real estate.
3. Properties with Conversion of Main Spaces into Residential Use:
  - The minimum value amounts to 250,000 €
  - The investment applies to only one (1) property
  - The minimum area restriction of 120 m² does not apply (the property may have main spaces of a smaller area)
  - The conversion of the main spaces into a residence must be completed after 05.04.2024 and before the submission of the residence permit application.
  - The change of use can be carried out either by the buyer or by the seller.
  - For example, a 160 m² store with conversion of main spaces into a residence on 04.04.2024 and a total price of 250,000 € CANNOT be used to obtain the permanent investor residence permit.
  - A 160 m² store with conversion of main spaces into a residence on 06.04.2024 and a price of 250,000 € CAN be used to obtain the permanent investor residence permit.
4. Industrial Buildings
  - The minimum value amounts to 250,000 €.
  - The minimum investment value applies to only one (1) property.
  - The minimum area restriction of 120 m² does not apply.
  - Within the definition of an industrial building, real estate that consists of an industrial building or part of an industrial building, or within which an industrial building is located, and provided that, in these cases, there has not been an established and operating industry for at least the last five (5) years, is also included.
  - Similarly, properties resulting from vertical or horizontal additions to industrial buildings, under the condition that their use changes to residential, or the addition of separate buildings on plots or grounds on which there are industrial buildings whose use changes to residential, are also included.
5. Protected Buildings *
  - An investment opportunity is provided through the purchase of real estate, in cases where it consists of a protected building or part thereof, or includes a protected building, intended for restoration or reconstruction.
  - The minimum value amounts to 250,000 €
  - The minimum area restriction of 120 m² does not apply.
  - The minimum investment value applies to only one (1) property.
  - Investments in properties resulting from vertical or horizontal additions for the restoration or reconstruction of protected buildings, or the addition of new independent buildings on plots or grounds on which there are protected buildings intended for restoration or reconstruction, are included.
  - * For the first renewal, full restoration of the property's elements or its complete reconstruction is required, regardless of the cause of deterioration, collapse, or demolition of the building or its parts. The transfer of the property in this case, before the full restoration or complete reconstruction is completed, is null and void.
  - For example:
    1. An apartment in Patra with 100 m² of main space, with a 10 m² storage room and a 10 m² parking space, with a selling price of 380,000€ for the apartment, 10,000€ for the parking space, and 10,000€ for the storage, totaling 400,000€, meets the minimum price requirement but not the minimum main space area requirement. Therefore, it CANNOT be used to obtain the permanent investor residence permit.
    2. An apartment in Patra with 120 m² of main space and a total selling price of 250,000€, meets the minimum main space area requirement but not the minimum value requirement. Therefore, it CANNOT be used to obtain the permanent investor residence permit.
    3. A store in Patra with an area of 80 m², with a total price of 250,000€ and conversion of main spaces into a residence on 07.04.2024 CAN be used to obtain the permanent investor residence permit, as in this case only the minimum value is considered and not the area of the main spaces.
    4. A detached house in Paleo Faliro, Attica, with 100 m² of main space, with a 30 m² storage and 2 parking spaces of 10 m² each, with a total selling price of 800,000€, meets the minimum price requirement but not the minimum main space area requirement. Therefore, it CANNOT be used to obtain the permanent investor residence permit.
  - Note: In the context of a single property for calculating the minimum value, the clarifying circular explicitly states that additional spaces (storage/parking space) may also be included in cases where the purchase concerns a property without a change in the use of main spaces, industrial properties, or protected buildings. For the latter special cases, there is no clear reference as to whether these spaces may be counted towards the minimum value.
  - This document relates exclusively to the new provisions for obtaining the permanent investor residence permit – investment in real estate. In any case, before a property is proposed as suitable for obtaining the residence permit, it is recommended to consult with a lawyer.
  - For property transactions carried out during the validity of transitional provisions, it is noted that for properties for which a deposit was given until 31.08.2024, different provisions apply. This document is issued subject to any later amending provisions and/or clarifying documents.
